The US Department of Justice once again requested detention: Zhao Changpeng can be sentenced to up to ten years, and the UAE may not release him

Given that there is no extradition treaty between the UAE and the United States, the offensive and defensive battle between the U.S. Department of Justice and the lawyers representing Binance founder Zhao Changpeng (CZ) is still ongoing. The Department of Justice seems very reluctant to let CZ return to the UAE to await the sentencing hearing.

Defense claim: CZ has no risk of absconding

According to legal documents, attorney CZ believes that while it is common for suspects awaiting trial to be detained when they reside in a country without an extradition treaty, this is an unusual case.

Because CZ had previously voluntarily appeared in court for trial, the judge also gave a positive evaluation at the bail hearing, believing that CZ was not a flight risk and should be granted freedom before sentencing.

Ministry of Justice prosecutor: CZ's sentence could be up to ten years

US prosecutors countered that, despite the defense's claim that CZ may face only a "short" prison term and has no motive to flee, the reality is that the maximum sentence could be 18 months, and the US could further seek a statutory maximum sentence of ten years.

The prosecutor pointed out that the defense emphasized that CZ has a family and has never been detained for more than a day, so the potential prison sentence will undoubtedly have a significant impact on CZ, which is more justifiable to impose travel restrictions on CZ.

Many factors are not conducive to CZ returning to the UAE. He has no connection with the United States. His family lives in the UAE and his property is all overseas. He is not only a UAE citizen, but also has special privileges. Although he has emphasized that he will not use this to circumvent US law, it also shows his close relationship with the UAE. In view of this, if CZ ultimately refuses to return to the United States, there is no reason to believe that the UAE will hand him over.
